Disk Shredder 7: Software License Agreement

Important: Please read this carefully before opening the package.

Please read the following license terms (hereinafter referred to as the "License Agreement") carefully before opening the package of the USB flash drive or DVD-ROM (hereinafter referred to as the “Media”).
These License Agreement cover the following two types of software (collectively referred to as the “Software”)
     The portion of the software contained in the media labeled
     "Disk Shredder 7 Light", "Disk Shredder 7 Standard",
     "Disk Shredder 7 Super" that is an application program
     excluding the operating system
This Software may be used by you only when you agree to the following terms. If you don't agree the following terms, please contact Personal Media Corporation (hereinafter referred to as “PMC”) before opening the package of the Media.
If you open the package of the Media for any reason whatsoever, you are deemed to agree to the License Agreement stated herein below.

Article 1. (Intellectual Property Right)

You may use the Media which is contained in this package. You do not, however, own the intellectual property right to this Software. The intellectual property right to this Software is owned by PMC or its software suppliers.

You are granted a non-transferable and non-exclusive right to use this Software.
The number of times to use this Software is unlimited.
You may have a third person designated by yourself take over the use of this Software for the purpose of shredding your data under your supervision and only in the case that such third person uses this Software in the office where your organization exists.
You may use this Software on a single computer system at a time per one Media which records this Software provided to you officially. If you need to use this Software on multiple computer systems at a time, you need to get the additional License of this Software for each computer systems.

You shall not copy this Software (including, but not limited to, any copy from the Media to hard disk, any archiving including this Software and any transmission to network) without PMC's written consent. Also you shall not copy this Software for back-up purpose.
You shall not modify, reverse engineer or disassemble, etc. this Software without PMC's written consent.
Except as set forth in Article 2.3 of this License Agreement, you shall not have any third party or parties use this Software without PMC’s written consent. Also you shall not assign or resell this Software and shall not use this Software for rental or lease business.

PMC may, without obtaining your prior permission or without prior notification to you, change to the specification of this Software or discontinue the manufacture and the sale of this Software.
In the event that the operation of this Software does not conform to the attached description, etc. of this Software, PMC makes effort to repair such Software for at least one year from the date you purchase this Software.

PMC warrants to the customer that the contents of the Software will be properly recorded on the media during the free-of-charge warranty period from the month of shipment of the Software as indicated on the user registration number sticker to the end of the same month of the following year.
In the event that the contents of this Software is not properly recorded in the Media or that the Media is damaged by the use of this Software, Sales Agency sends the replacement for free by your return of such Media to Sales Agency during the free warranty period.
The free warranty set forth in the preceding paragraph shall not be applicable for misuse or abuse which does not comply with the description of this Software, or modification of this Software or willful damage.
If the media is damaged after the free-of-charge warranty period has elapsed, PMC may sell a replacement at an amount separately determined by PMC at that time by returning said media to PMC.PMC reserves the right to discontinue this service without prior notice to the customer in the event that the sale of the software is discontinued.
PMC warranty with regard to this Software shall be limited as provided above.

PMC does not warrant that the functions of this Software will meet your requirements or that the operation of this Software will be uninterrupted or that there is no error resulted from such operation of this Software. Also PMC does not warrant to you that this Software will infringe intellectual property rights of third parties or be available permanently.
PMC shall not have any liability for damages arising from direct or indirect damages in connection with the performance or the result of the operation of this Software. Some states or districts do not allow the exclusion of the limitations of liability set forth in this Article or paragraph by imperative laws, so the above limitations may not apply.

This License Agreement do not alter your rights under consumer protection laws.
The laws of Japan shall govern this License Agreement.
If any provision of this License Agreement is held invalid by law, the remaining provisions shall remain in full force and effect.
If any dispute arises concerning this License Agreement between you and PMC, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
You shall not export, ship or transport this Software to any state which such export, shipment or transportation is prohibited by any laws, etc. related to the export control such as the Japanese Foreign Exchange and Foreign Trade Law.
